Terms and Conditions


Please note that by agreeing to use the Super8Ireland Service, you are confirming that you have reviewed our Terms & Conditions and agree to be bound by them.
As a result, by placing an order and/or supplying Super8 Ireland with material for conversion or editing, the customer thereby accepts Super8 Ireland's conditions of business below.

Customers Warranty

By availing of the Super8Ireland Service, the Customer warrants that it owns the copyright of the goods in their entirety and/or has obtained the necessary licence to procure and manufacture the sale of the goods.
Provided that the customer owns the copyright, availing of Super8Ireland's services means that the customer does keep this copyright and that Super8 will respect this copyrighted material.
No copy protection will be added to this material, so that the customer may keep distributing their copyrighted material freely.

The Customer further warrants that any such redistribution and manufacture of the goods does not infringe the rights of any such third parties. It is unilaterally agreed that Super8Ireland shall not be held liable, financially or otherwise for any claims pertaining to the copyrighted work by any third party. In the event of any action being taken against Super8Ireland as a result of works completed at the Customers request, the Customer warrants that it will indemnity Super8Ireland entirely, against any costs or steps taken in relation to said claim.

It is further warranted by the Customer that the content of the material supplied to Super8Ireland is free from any obscenities, and does not contain any material which would be found to be objectionable, illicit, illegal, or criminal in nature.

The Customer agrees that in the event of any action being brought by any party as a consequence of the content of the material supplied by the Customer to Super8Ireland, the Customer will irrevocably fully indemnify, and keep indemnified, Super8Ireland against any costs incurred in such an Action.


Payment Policy

All film equipment, accessories and filmstock must be paid in full before delivery.
For transfer projects under 200 euros, full payment is required to start the project.
For all other projects, Super8 Ireland requires at least 50% of the total upfront to start the project,
with the full balance before delivery.
Please note that no transfer project will be delivered without balance being paid in full. In the case of drafts, cheque, transfers from bank accounts and similar transactions, funds must have fully cleared before Super8 Ireland can consider the payment completed.

Storage of the Materials

Super8Ireland may retain a digital copy of the content of the material onsite for backup purposes for customers. Once a digital version has been supplied to the customer, the content of the material supplied may be destroyed/ deleted.
In the event of a customer losing or damaging their own copy (for digitized super8 material), they are welcome to contact Super8Ireland to check whether they may have held a digital copy, as there may then be a way to recreate a copy for the customer, should it still stored in Super8Ireland's system. Super8 Ireland can not be held accountable for the loss/destruction of the footage subsequently to the digital delivery of contents to the customer.

Privacy and Security

Any personal information provided to Super8Ireland is provided with the knowledge that Super8Ireland intends to take reasonable and appropriate steps to protect the personal information from unauthorised access and detection.

Super8Ireland may keep personal information on file for future usage and may send the Customer updates about special offers, programs, new products and/or new services which Super8Ireland believes the customer may be interested in. The user will be able to unsubscribe from the mailing list at any time after receiving the first information message. Alternatively, if the Customer does not want their information to be stored for such future use, the Customer shall inform Super8Ireland in writing of this request.

Super8Ireland does not intend to transfer personal information without your consent to third parties not acting on Super8Ireland’s behalf unless such transfer is legally required.

Delay

Super8Ireland will endeavour to complete projects as soon as possible.
Lead time can vary from weeks to months and sometimes more depending on a number of factors, such as availability, how busy we are,
(outside large projects or specialized projects involving restoration for example), however, in the event of any delay incurred in the completion of the order, Super8Ireland shall not be liable for any claim in relation to same, and can extend the time for delivery without prior notification to the customer, provided same is reasonable in all the circumstances.
In the event of material being in bad condition when supplied to Super8 Ireland (physical damage for example) or the contents containing some bad quality footage, completion of the project may be logically delayed as a result.

One note on outdated films for processing (not actual reels but original films such as Agfa and Kodachrome40 carts that were never sent to the lab): We offer a service to process outdated films via a third party. However, we can neither guarantee the quality of the processed material (there is a risk no image may be left on outdated films for example) nor have accept any responsibility for delays in processing outdated films. Our recommendation for unprocessed outdated film cartridges is to firstly focus on already developped cine material on reels, as not only will the quality/condition of the film should be far better, but the leadtime to completion also shorter. Should you nevertheless decide an old unprocessed cartridge from the 70s or 80s for instance is still worth your while developing, you need to accept the results may not be as good as you are hoping and that you may have to wait a long period of time to get the processed film back (because this is such a rare request and that process requires special handling and chemicals that are rare and expensive).
There is the possibility to rush outdated films project, but same again, we don't advise it as we deem those costs too expensive.
In comparison, newer film emulsions by Kodak such as Ektachrome (color E6), TriX B&W reversal and Vision negative filmstocks can be turned around in less than a week in some cases (for rush projects).

Sending and Return of Materials

Super8Ireland reserves the right to use the services of third parties for the purposes of collection and delivery of materials. Any such third parties so involved are independent persons and are not Agents acting on behalf of Super8Ireland. Any shipment containing original customer's material is done by tracked services (whether courier or postal)

Super8Ireland does not assume responsibility nor accept liability for any loss occasioned or damage suffered to the materials from the collection/delivery process by the said third parties.

Any disputes in relation to loss of or damage to the materials during transit should be taken up directly with the third party so involved.

Sub-contracting to Third Parties

All 8mm, 9.5mm and 16mm Scanning is done in-house. However, Super8Ireland, reserves the right to sub-contract out certain specialized works to third parties, at their discretion. This (but not only) could apply to very damaged films needing special chemical treatment, certain videotape formats (videotapes with mould or other damage for example). Film development may also be sub-contracted to third parties at Super8 Ireland's discretion, as Super8 Ireland does mainly specialize in digitizing & video production. Super8Ireland confirms that should any such works be sub-contracted to a third party, the Terms and Conditions herein stated shall apply with full effect. In this case Super8 Ireland does it best to inform the customer, in the event of subcontracting, in order to be as transparent as possible.

Disclaimer for Loss or Damage to Customer Goods

Super8Ireland will take reasonable care, in all the circumstances, to ensure that the materials provided are returned to the Customer in the same condition as they were received in.

Super8Ireland, however, does not assume responsibility for the materials provided to them and any materials given to Super8Ireland for the purpose of availing of their Service are provided at the owners risk and no responsibility, financial or otherwise is accepted by Super8Ireland for any loss or damage thereto. In the event that any materials provided have been lost, damaged and/or destroyed by Super8Ireland, Super8Ireland accepts no liability for any consequential or indirect loss suffered by the Customer, whatsoever and howsoever caused.

Cancellation Policy

In the event that the Customer wishes to cancel their order, same can be done free of charge within 48 hours of the order having been made, provided always that no work has been commenced on the material provided and no transport or related costs have been incurred by Super8Ireland or any other third party.

If any work has been commenced on behalf of the Customer before the cancellation is made, to include any transport or related costs, the Customer shall be liable for same, without exception.

General Use Provisions

All materials provided on this website, including but not limited to information, logos, images, graphics and services ("Materials") are provided by Super8Ireland or by their third party providers are the copyrighted work of Super8Ireland and/or its third party providers. Except as stated, none of these materials may be copied, reproduced, distributed, republished or transmitted in any form or by any means without the express written permission of Super8Ireland.

This website may contain links to third party sites controlled by parties other than Super8Ireland. Super8Ireland is not responsible for and does not accept any responsibility for the contents or use of these third party sites. It is your responsibility to take precautions to ensure that whatever is selected for use is free of viruses or other items of a destructive nature.

Video Quality of converted footage

In the event of the original material to convert or edit being in bad condition, or bad quality to start with, Super8 Ireland will not accept responsibility or liability, should the client not be happy with the results. For example (but not exclusively), if footage appears to be underexposed (too dark), overexposed, out of focus, to have heavy colour shifts, to be jittery (stability/framing issues) or to have any issue due to poor use or condition of the original camera, a faulty camera/film etc, Super8 Ireland will not be held liable for poor quality results and will require payment for the work carried out. Another example would be film that has not been processed on time and may therefore suffer in terms of quality, as far as having little or no image present once it has been developped.

We will do our best to make the most out of bad quality footage supplied to us for conversion, but a fair usage policy applies.
Also, however much improvement can be achieved with digital tools, you can not expect wonders when some of the original material supplied for conversion or editing suffers from quality issues.
In other words, we can only try and make the footage look as good as the original, which thankfully in a lot of cases is of acceptable quality to start with.


Fair usage & Video editing

A fair usage policy applies if your project includes editing and a preview. (please check with us before placing the order if you are unsure whether a particular service includes preview and/or editing of your footage).
For example but not exclusively, with a Super8 film transfer project including the preview&editing add-on, the amount of 50ft reels/increments you digitize allow you to create up to 20 chapters with a DVD menu (and their corresponding titles). Should you wish to specify further titles to be added, additional charges may apply, as part of our fair usage policy, in order to take into account the additional amount of work required to carry out those edits.
The idea of the review tool when offered, is for you to allow us to give us clear instructions via our interface only.
Note that the digital preview is done by ways of private video links on the cloud. This requires the customers of Super8 Ireland to have access to the necessary computer hardware, basic IT knowledge and a fast enough internet connection to stream/download the media.
If we deem the customer's instructions to be unclear or too complex for what the review entitles them to, we reserve the right to output the media as they are, ie as separate files or in a random sequence as we see it fit.

Media compatibility

We use the highest quality media. For DVDs and Blu-Ray discs, should you have a compatibility issue with your own player, we cannot accept responsibity for an incompatibility and you may have to upgrade to a newer DVD or Blu-Ray player if the disc presents no fault. In the event of a DVD or Blu-Ray media being faulty, Super8ireland will replace that media for you.
Should you have any doubts as regards compatibility, you may ask Super8 Ireland for a sample DVD, in order to check we provide you with suitable media for your setup.
In the vast majority of projects, Our media will play in customers' DVD players, and in the (Murphy's law) unlikely event of incompatibility, we will replace the media for you. Please also note that most older DVD players for instance have no "upscaling" capability when used in conjunction with a modern HDTV. As a result, the upscaling job is left to the HDTV/Smart TV, which will do a poor job of it. As a result, we recommend you upgrade your DVD player to a more recent one or to a Blu-Ray player, as it will significantly improve the picture quality of any DVD you play with it (in won't magically turn non HD footage into HD, but will help display the image better on a HD screen)

Limitation of Liability

Super8Ireland shall not be liable for any damages whatsoever and howsoever caused and suffered as a result of using the materials and/or information on the website.

Super8Ireland shall not be liable for any damage whatsoever and howsoever suffered by the Customer nor any other individual as a result of using the services of Super8Ireland. In no event shall Super8Ireland be liable for any indirect, special, punitive, incidental or consequential damage however it arises, whether in an Action of contract, negligence or other tortuous Action, even if Super8Ireland has been previously advised of the possibility of such damage.

Terms and Conditions Changes

Super8 Ireland may change the terms & conditions without notification
Super8 Ireland may change, add or delete these Terms and Conditions or any portion thereof from time to time in its sole discretion where it deems it necessary for legal, general regulatory and technical purposes, or due to changes in the services provided or nature or layout of the Website. Thereafter, you expressly agree to be bound by any such amended Terms and Conditions.
